Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Passion Highway, Inc. ("Company," "we," "us," or "our") concerning your access to and use of the AviatorDB website and the AirplaneID mobile application (collectively, the "Services"). AviatorDB and AirplaneID are service marks of Passion Highway, Inc.

By accessing or using our Services, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Services.

Eligibility

You must be at least 13 years of age to use our Services. By using the Services, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

Account Registration

To access certain features of the Services, you may be required to register for an account. When you register, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

Subscription and Payments

Some features of our Services require a paid subscription. By subscribing to a paid plan, you agree to pay all applicable fees. Subscription fees are billed in advance on a recurring basis according to your chosen billing cycle.

You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing period. We do not provide refunds for partial subscription periods unless required by applicable law.

Acceptable Use

You agree not to use the Services to:

• Violate any applicable law, regulation, or third-party rights
• Upload or transmit viruses, malware, or other harmful code
• Interfere with or disrupt the Services or servers
• Attempt to gain unauthorized access to any part of the Services
• Collect or harvest user information without consent
• Use the Services for any illegal or unauthorized purpose
• Impersonate any person or entity
• Engage in any conduct that restricts or inhibits anyone's use of the Services

User Content

Our Services allow you to upload, submit, store, and share content, including photographs, sighting data, and other materials ("User Content"). You retain all ownership rights in your User Content.

By uploading User Content, you grant us a limited, non-exclusive license to use, store, and display your User Content solely for the purpose of providing the Services to you. We will not use your User Content for AI training purposes or share it with third parties without your consent, except as required by law.

You are solely responsible for your User Content and represent that you have all necessary rights to upload such content and that it does not violate any third-party rights or applicable laws.

Intellectual Property

The Services, including all content, features, and functionality (excluding User Content), are owned by Passion Highway, Inc. and are protected by copyright, trademark, and other intellectual property laws.

AviatorDB and AirplaneID are service marks of Passion Highway, Inc. You may not use our trademarks, logos, or service marks without our prior written permission.

Third-Party Services and Data

Our Services may integrate with or display data from third-party sources, including aviation registries and databases. We strive for accuracy but do not guarantee the completeness or accuracy of third-party data. Such data is provided for informational purposes only and should not be relied upon for operational aviation decisions.

Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, error-free, or secure, or that any defects will be corrected. We make no warranties regarding the accuracy or reliability of any information obtained through the Services.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PASSION HIGHWAY, INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

Our total liability for any claims arising from or relating to these Terms or the Services shall not exceed the amount you paid to us in the twelve months preceding the claim.

Indemnification

You agree to indemnify, defend, and hold harmless Passion Highway, Inc. and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your User Content, or your violation of these Terms.

Termination

We may terminate or suspend your account and access to the Services at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Upon termination, your right to use the Services will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in Cook County, Illinois.

Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by updating the "Last updated" date at the top of these Terms. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.
